Buying Property 

Step 1 - Pre contract

We will review the contract and provide advice on the conditions of the contract and the obligations imposed on you; provide advice on pre-purchase inspections you should obtain; liaise with the financier to obtain loan approval; and negotiate any special conditions or alterations to the contract.

Step 2 - Contract exchange

Arrange for the signing of the contract; payment of the deposit; ensure your finance is in order; and make arrangements for the contracts to be exchanged.  We won’t enter you into a contract until all the boxes are ticked and you have authorised us to do so.

Step 3 - Before settlement

We will investigate the title to the property by obtaining the necessary searches and reviewing the results. We prepare forms required by NSW Land Registry Services for registration; attend to the payment of government stamp duty; liaise with other parties including the real estate agent and the vendor’s solicitor; calculate adjustments for council and any other rates or levies on the property; confirm settlement arrangements. We can also arrange government grants if applicable.

Step 4 - Day of settlement

Carry out final searches with NSW Land Registry Services and attend and complete settlement on your behalf.

Step 5 - After settlement

Lodge documents with NSW Land Registry Services to transfer the title to you and record the change of ownership; ensure payments of rates and levies required to be paid by the the vendor; confirm settlement to you and provide copies of documentation and a balance sheet showing the distribution of funds.

If you hope to buy a property at auction, contact us before the auction. The contract should be reviewed, pre-purchase inspections obtained and finance approved prior to the auction. You do not have a cooling off period when you purchase at auction.

Selling Property

Step 1 - Contract preparation 

You must have a contract before you can advertise a property for sale. We will order the searches and certificates required and obtain your instructions; prepare the contract to protect your interests; issue the contract to your real estate agent so they can advertise the property for sale. 

Step 2 - Contract exchange

Negotiate the terms of the contract and any alterations requested by the purchaser; advise you of the effect of such alterations; complete the contract once agreement is reached; make arrangements for signing the contract and attend to the exchange of contracts. The agreement is not binding on either party until contracts are signed, dated and exchanged. 

Step 3 - Before settlement

Reply and respond to relevant correspondence or title questions received from the purchaser; request your mortgagee to prepare documents to pay out your loan and release the property (discharge your mortgage); ensure all appropriate documents are prepared correctly and signed by you to enable the sale to be completed; confirm settlement arrangements and figures.  

Step 4 - Day of settlement

Complete settlement and advise you and your real estate agent when the sale is complete, authorising them to transfer the deposit to you. 

Step 5 - After settlement

We will confirm settlement to you and provide copies of documentation and a balance sheet confirming the distribution of funds.
